The Compassionate Horse Click is an educational program of Victory Land Dressage Inc, owned by Melissa Spell Deal Release of Liability and Service Agreement
This agreement is entered into between participants (hereinafter referred to as “Client”) and Victory Land Dressage, the owner of Compassionate Horse Click program and material, (hereinafter referred to as “Company”) for services starting on the date of purchase.
- Company will provide Client with educational services as described in this agreement. The total fee for these services is $169.00 per month, non-refundable once charged. This will be a recurring monthly fee automatically charged to the Client’s credit card on file for the lifetime of the course or until the client provides written notification of cancellation at least 7 days prior to the scheduled monthly charge for the course. Note that once payment is incurred, cancellations will apply to future purchases only.
- Company’s services are intended to serve the following purposes:
- Provide education and interactive community supporting the understanding of horse behavior and growth of client’s positive reinforcement horse training skills.
- Company’s services will include:
- group calls (minimum one time per month, additional bonus calls may be included)
- access to a private Facebook group or other forum platform of supportive like-minded students
- access to educational material included in course lessons
- Client agrees that Victory Land Dressage, Compassionate Horse Click and all associates are relieved from any responsibility with regard to safety, injury or results of training on either part of horse or human.
- Venue and Dispute Resolution: The parties agree that the terms of this agreement were jointly drafted and agreed upon.
- Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by arbitration.
- The company does not warrant or guarantee any specific level of performance or results. The results of the program may vary based on a variety of factors.
- I agree that pictures, recordings and/or video clips maybe publicly posted at management discretion.
- I agree that I will not post or share videos, pictures or any material provided by the Compassionate Horse Click program, it's members, associates/staff or Melissa Deal or their voices without written permission.
- I agree that I will not share my login information with anyone that is not a paying member of the Compassionate Horse Click program.
WARNING
An equine activity sponsor or equine professional is not liable for an injury to or the death of a participant in equine activities resulting exclusively from the inherent risks of equine activities. Chapter 99E of the North Carolina General Statutes.
- Inherent Risks and Assumption of Risk. The undersigned acknowledges that there are inherent risks associated with equine activities such as described below, and hereby expressly assumes all risks associated with participating in such activities. The inherent risks include, but are not limited to the propensity of equines to behave in ways such as, running, bucking, biting, kicking, shying, stumbling, rearing, falling or stepping on, that may result in an injury, harm or death to persons on or around them; the unpredictability of equine’s reaction to such things as sounds, sudden movement and unfamiliar objects, persons or other animals; certain hazards such as surface and subsurface conditions; collisions with other animals; the limited availability of emergency medical care; and the potential of a participant to act in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the animal or not acting within such participant’s ability.
Participant acknowledges that horses, by their very nature are unpredictable and subject to animal whim. Participant assumes all risks in connection therewith, and expressly waives any claims for any injury or loss arising therefrom. Participant further acknowledges that the behavior of any animal is contingent to some extent upon the ability of Participant. Participant assumes all risks. Participant expressly releases Management from any and all claims for personal injury or property damage, including but not limited to any incident caused by or related to negligence by Management or its representatives, agents, affiliated persons or employees. This release applies to the signatory and the horse(s), equipment, or personal property involved in activities associated with Victory Land.
- Participant agrees to assume any and all risks involved in or arising out of Participant's use of any equipment or livestock pertaining to the consultation, advice or lessons given off the premises or virtually by Management personnel.
- PARTICIPANT (OR PARTICIPANT’S PARENT OR GUARDIAN IF PARTICIPANT IS A MINOR) AGREES TO HOLD HARMLESS, INDEMNIFY AND DEFEND MANAGEMENT AGAINST ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, JUDGMENTS, ORDERS, COSTS OR EXPENSES, INCLUDING ATTORNEY'S FEES, WHICH MAY IN ANY WAY ARISE FROM OR BE IN ANY WAY CONNECTED WITH PARTICIPANT'S USE OF ADVICE, GUIDANCE OR PRESENCE UPON THE PROPERTY OF MANAGEMENT, AND THE FACILITIES LOCATED THEREON, OR PARTICIPANT’S USE OF OR PARTICIPATION IN VIRTUAL TRAINING. In the event Participant is a minor, the parent or guardian shall further indemnify, defend and hold Management harmless from any such claims by said minor child.
- Participant agrees to waive the protection of any applicable statutes in this jurisdiction whose purpose, substance and/or effect is to provide that a general release shall not extend to claims, material or otherwise, which the person giving the release does not know or suspect to exist at the time of executing said release.
By checking the box provided, I represent that I have read this agreement and that I fully understand the agreement. I acknowledge that equine activities involve the risk of serious bodily injury including but not limited to permanent disability, paralysis, and even death. I represent that I am in good health and proper physical condition to participate in these activities. I acknowledge that equine activities are dangerous activities and I understand the nature and risk of participating in equine activities. I understand that this release is intended to fully release Victory Land Dressage, Inc., Compassionate Horse Click, management, staff and its affiliates from any liability whatsoever, including incidents resulting from all activities whether on or off the equine.
