WARNING

Under North Carolina law, an equine activity sponsor or equine professional is not liable for an injury to or the death of a participant in equine activities resulting exclusively from the inherent risks of equine activities.  Chapter 99E of the North Carolina General Statutes.

 

  1.         Inherent Risks and Assumption of Risk. The undersigned acknowledges that there are inherent risks associated with equine activities such as described below, and hereby expressly assumes all risks associated with participating in such activities. The inherent risks include, but are not limited to the propensity of equines to behave in ways such as, running, bucking, biting, kicking, shying, stumbling, rearing, falling or stepping on, that may result in an injury, harm or death to persons on or around them; the unpredictability of equine’s reaction to such things as sounds, sudden movement and unfamiliar objects, persons or other animals; certain hazards such as surface and subsurface conditions; collisions with other animals; the limited availability of emergency medical care; and the potential of a participant to act in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the animal or not acting within such participant’s ability. 

 

Participants acknowledge that horses, by their very nature are unpredictable and subject to animal whim. Participant assumes all risks in connection therewith, and expressly waives any claims for any injury or loss arising therefrom. Participant agrees to abide by and follow Management’s Policies, attached hereto as Exhibit A, which shall be posted and/or available from time to time. Participant further acknowledges that the behavior of any animal is contingent to some extent upon the ability of Participant. Participant assumes all risks therefore and warrants a full and fair disclosure of Rider's abilities has been made to Management. Participant expressly releases Management from any and all claims for personal injury or property damage, including but not limited to any incident caused by or related to negligence by Management or its representatives, agents or employees. This release applies to the signatory and the horse(s), equipment, or personal property involved in activities associated with Victory Land.

 

  1.         Participant agrees to assume any and all risks involved in or arising out of Participant's use of any equipment or livestock pertaining to the consultation, advice or lessons given off the premises or virtually by Management personnel.
  2.         PARTICIPANT (OR PARTICIPANT’S PARENT OR GUARDIAN IF PARTICIPANT IS A MINOR) AGREES TO HOLD HARMLESS, INDEMNIFY AND DEFEND MANAGEMENT AGAINST ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, JUDGMENTS, ORDERS, COSTS OR EXPENSES, INCLUDING ATTORNEY'S FEES, WHICH MAY IN ANY WAY ARISE FROM OR BE IN ANY WAY CONNECTED WITH PARTICIPANT'S USE OF OR PRESENCE UPON THE PROPERTY OF MANAGEMENT, AND THE FACILITIES LOCATED THEREON, OR PARTICIPANT’S USE OF OR PARTICIPATION IN VIRTUAL TRAINING.  In the event Participant is a minor, the parent or guardian shall further indemnify, defend and hold Management harmless from any such claims by said minor child.

 

  1.         Participant agrees to waive the protection of any applicable statutes in this jurisdiction whose purpose, substance and/or effect is to provide that a general release shall not extend to claims, material or otherwise, which the person giving the release does not know or suspect to exist at the time of executing said release. 

 

By signing this educational/consultation/lesson agreement, I represent that I have read this agreement and that I fully understand the agreement.  I acknowledge that equine activities involve the risk of serious bodily injury including but not limited to permanent disability, paralysis, and even death.  I represent that I am in good health and proper physical condition to participate in these activities.  I acknowledge that equine activities are dangerous activities and I understand the nature and risk of participating in equine activities.  I understand that this release is intended to fully release Management from any liability whatsoever, including incidents resulting from all activities whether on or off the equine.

Live Event with Melissa Spell Deal

We are sooooo excited about having you, compassionate equestrians, join us for the upcoming live event with Melissa Spell Deal, certified CT Coach and ARIA Riding Instructor + USDF Bronze Medalist. 

We will start on Friday afternoon/evening after you arrive and settle in.
 
The event will be based on what YOU are interested in LEARNING,  SEEING, BEING AND DOING to a great degree! 

Please submit your topic requests and include specifics. What would you like to learn more about, understand more thoroughly, see someone do, practice yourself etc.

Think about the things you dream of doing with your horse as well as current goals and challenges that you may be facing with your horse.

Potential TOPIC List:
 Understanding what your horse is communicating and how to respond appropriately to enhance relationship, connection, behavior and performance! (reading behavior, timing and presentation)
 Fading the Food from Confirmed Behaviors – why, when and how + Duration
 Excitement, Arousal and Motivation – create it, shape it, or tone it down to promote health, happiness and well being of horses and people!
 Feeding under saddle – why, when and how in a variety of circumstances and situations.
 Liberty

We have 5 overnight participant paddocks and limit to 1-2 haul ins on a case by case basis to keep the interaction intimate and enhance opportunities to learn. Registration will close when these spots are filled. (Paddocks include access to water and hay huts. Dry paddocks 20$ per night payable upon arrival and may include > than one horse).

Proper protective footwear, long pants and helmets required if you are interested in riding.
